Two men charged with attempting to steal vehicle from casino parking lot

PLAINS TWP. — Police in Plains Township charged two men on allegations they attempted to steal a vehicle from the parking lot of Mohegan Pennsylvania casino early Tuesday morning.

Henry David Pena-Acosta, 27, of Scranton, and Jose Delvy Rodriguez, 23, of Bronx, NYC, fled the casino’s parking lot when they got “spooked” by a shuttle bus after forcing open a locked door to a Honda just before 2:30 a.m., according to court records.

Pena-Acosta and Rodriguez sped away in another Honda reported stolen in New York City, court records say.

Police pursued the pair into Wilkes-Barre City where they abandoned the stolen Honda at the end of Dillon Street.

Pena-Acosta jumped down an embankment where he was found hiding as Wilkes-Barre police apprehended Rodriguez, court records say.

Police in court records say the stolen Honda had a license plate registered to another vehicle.

Six key fobs, a magnetic pen, and a ratchet were found inside the stolen Honda, court records say.

Pena-Acosta was charged with receiving stolen property, criminal conspiracy to commit theft, unauthorized use of a motor vehicle, evading arrest, criminal conspiracy to commit theft, driving without a license, driving with a suspended license and speeding.

Rodriguez was charged with criminal conspiracy to commit theft, evading arrest and criminal conspiracy to commit theft.

District Judge Alexandra Kokura Kravitz of Pittston arraigned Pena-Acosta and Rodriguez, who were jailed at the Luzerne County Correctional Facility for lack of $25,000 bail, each.
